Niharika Sachdeva represents clients in all facets of commercial litigation. Her cases are highly complex and technical, spanning a range of industries, including banking, finance, healthcare, and life sciences, as well as state, national, and international regulatory schemes.
Most recently, she was part of a trial team that won a defense verdict for Sutter Health in defeating a $500 million qui tam action related to charges for health care services. The case was named a Top Defense Verdict of 2024 in California by the Daily Journal. She also successfully defended the Scripps Research Institute and two award-winning chemists in a lawsuit brought by a venture capital firm partner, winning a complete victory on summary judgment.
Before joining the firm, Niharika served as a judicial clerk for Judge William Shubb of the U.S. District Court for the Eastern District of California. She earned her law degree from the University of California, Davis, Law School, where she served as a judicial extern for Associate Justice Goodwin Liu of the California Supreme Court and as a law clerk in the Family Protection Clinic. She earned her bachelor's degree from the University of Oregon with a double major in political science and journalism.
District Council #16 v. Sutter Health et al.
We represented Sutter Health in class action litigation alleging Unfair Competition Law claims related to charges for anesthesia services. After aggressively litigating the case, we negotiated a favorable settlement on behalf of Sutter Health.
In re: SKAT Tax Refund Litigation
We represented a former law firm partner in settling a fraud action brought by the government of Denmark in the Southern District of New York. The case involved claims that the lawyer set up pension plans and assisted them in purporting to invest in, and then unwinding, transactions in dividend-paying Danish companies to obtain a half-billion dollars’ worth of tax refunds, thereby defrauding Denmark’s tax authority.
California ex rel. Duncan et al. v. Sutter Health et al.
We represented Sutter Health in defeating a qui tam action alleging violation of California's Insurance Frauds Prevention Act in a case related to charges for health care services. Following a seven-week bench trial, we obtained a complete victory. The judge ruled that there was no fraud, that Sutter charged for recovery room care that was “medically ordered, appropriate, and supervised,” and that Sutter’s charges were consistent with standard industry billing practices.
T.H. v. FCI Dublin and U.S. Bureau of Prisons
We petitioned for our client's compassionate release from the women's correctional facility in Dublin, Calif. Investigations uncovered rampant sexual abuse by corrections officers and resulted in at least nine convictions, including the former warden, former chaplain, and the officer who abused our client. Despite the government’s forceful opposition, we persuaded the court to release our client.
Clarke v. Yu
We defended The Scripps Research Institute and two award-winning chemists against a lawsuit brought by a venture capital firm partner who alleged he had entered into an oral joint venture agreement to develop and commercialize groundbreaking carbon-hydrogen activation technology. After nearly 18 months of litigation, the court granted summary judgment in favor of defendants, which was affirmed on appeal.
Daedalus Prime v. Google
We are defending Google against a five-patent case brought by Daedalus Prime in the Western District of Texas targeting alleged power-management functionalities in Google’s Tensor system-on-chip products and Axion processors.
