The Am Law Litigation Daily gave a shout-out to Keker, Van Nest & Peters trial team in its weekly Litigators of the Week column for defeating a lawsuit brought by venture capitalist John Carke against The Scripps Research Institute and two award-winning chemists.
Clarke, of Cardinal Partners, claimed he had entered into a joint venture agreement with Dr. Jin-Quan Yu and Dr. Benjamin Cravatt to develop and commercialize Dr. Yu’s groundbreaking carbon-hydrogen activation technology, and that Drs. Yu and Cravatt breached the agreement. Clake also accused Scripps of intentionally interfering with the joint venture.
After 18 months of litigation, Judge Gregory Pollack of the San Diego Superior Court granted summary judgment on October 4 in favor of defendants. He ruled that Clarke failed to establish the existence of a joint venture or any other valid claims against any of the defendants.
