Candice is a seasoned commercial litigator who represents clients ranging from early-stage companies to Fortune 500 corporations in complex disputes. Her practice includes intellectual property, contract, and commercial litigation in state and federal courts at both the trial and appellate levels. Candice also has significant experience arbitrating matters before JAMS and the American Arbitration Association, often in cases involving sophisticated technologies and high financial stakes.
Candice has played central roles in defending technology and life-sciences companies in high-stakes litigation. She successfully defended Comcast in a patent infringement action targeting its voice-recognition and control technology, securing favorable claim constructions and ultimately a stipulation of non-infringement and dismissal with prejudice. She also helped Electronic Arts defeat an emergency injunction and secure dismissal of a lawsuit challenging EA’s group name, image, and likeness licensing agreements. She helped secure a significant victory for InterMune in Delaware Chancery Court against the company’s former CEO, defeating claims that a presidential pardon entitled him to retain millions of dollars in legal fees and costs.
Candice maintains an active pro bono practice. Currently, she is suing the state of Georgia seeking to enjoin its racially discriminatory voting laws. Candice also regularly represents asylum seekers and indigent criminal defendants, including recently obtaining asylum for a political activist from Cameroon.
Fiercely dedicated to diversity and inclusion, Candice was selected as a 2021 Pathfinder through the Leadership Council on Legal Diversity. She also serves on the Board of Directors of the Diasporic Vietnamese Artists Network (DVAN), and GenUnity, a civic engagement non-profit.
Prior to joining Keker, Van Nest & Peters, Candice served as a law clerk to Judge Allyson K. Duncan of the U.S. Court of Appeals for the Fourth Circuit and Judge Richard F. Boulware, II of the U.S. District Court for the District of Nevada. She was formerly an associate with a large firm in New York.
Promptu v. Comcast Cable Communications
In the Eastern District of Pennsylvania, we successfully defended Comcast against patent infringement and state-law contract and tort claims brought by Promptu targeting Comcast’s voice recognition and control technology. Following a Markman hearing that resulted in favorable claim constructions across the board, we secured a stipulation of non-infringement and dismissal with prejudice of the remaining claims.
ParkerVision, Inc. v. Qualcomm Inc., et al.
We represent Qualcomm in a patent infringement case in the U.S. District Court for the Middle District of Florida that alleges infringement of radio frequency technology-related patents.
The Brandr Group v. Electronic Arts
Representing Electronic Arts, we secured the dismissal of a lawsuit by The Brandr Group, which claimed EA was circumventing its agreements with dozens of Division I schools by offering group name, image, and likeness licensing deals directly to football players. After we defeated a TRO petition, The Brandr Group withdrew its lawsuit, paving the way toward a summer 2024 release of a new college football video game for the first time since 2013.
