On August 1, KVP team – Laurie Carr Mims, Ben Rothstein, Candice Mai Khanh Nguyen, Melissa Cornell, and Catherine Porto – successfully secured a significant victory for their client InterMune against the company’s former CEO W. Scott Harkonen. Harkonen, previously convicted of felony wire fraud in 2009 and pardoned by President Trump in 2021, had argued that the pardon vindicated his legal defense and allowed him to keep the legal fees fronted for his defense and the money spent pursuing the pardon. However, Vice Chancellor Nathan Cook determined that Harkonen wasn’t entitled to the funds used for his criminal defense nor the money spent on obtaining the pardon, entitling KVP’s client to recover $5.9 million.
