About Mr. Berkowitz

Ben Berkowitz helps companies and senior executives avoid and resolve complex business disputes and intellectual property litigation. Mr. Berkowitz is an experienced trial lawyer who has won numerous civil and criminal cases, including as lead counsel in more than a half-dozen jury trials. He also has a track record of winning cases early in the process before trial through strategic motions practice. He handles cases in state and federal courts throughout the United States.

In 2012, Mr. Berkowitz was part of a trial team that won a complete defense judgment against the U.S. Department of Justice in a case in which the government had accused his clients of fraud and sought nearly $1 billion in damages and penalties. After trial, the U.S. Department of Justice chose not to appeal the defense judgment.

Of course, not every dispute should turn into litigation and not every case should go to trial. By focusing on his clients’ business objectives, Mr. Berkowitz develops efficient legal strategies to achieve each client’s specific goals in a cost-effective manner. His clients include leaders within the Internet, venture capital investment, professional services, software and hardware design, healthcare, and financial services industries.

Mr. Berkowitz speaks frequently on topics relating to complex commercial litigation and intellectual property law. He also has litigated numerous civil rights cases as part of his active pro bono practice.

He is a graduate of Harvard Law School, J.D., cum laude, and was Executive Editor, Harvard Civil Rights - Civil Liberties Law Review.
