Keker, Van Nest & Peters Named a Law360 “Legal Lion" for Securing Full Federal Circuit Reversal

Keker, Van Nest & Peters was included in Law360's "Legal Lions of the Week" column after securing an appellate victory for Google LLC before the U.S. Court of Appeals for the Federal Circuit sitting en banc.

The en banc panel ordered a new damages trial in a case in which a jury told Google to pay $20 million for infringing an EcoFactor Inc. thermostat patent. The court ruled that the testimony of EcoFactor's damages expert was unreliable and should not have been admitted.

Keker, Van Nest & Peters represented Google at trial in the Western District of Texas in 2022, and Keker attorneys successfully petitioned for the en banc review in September 2024, marking the Federal Circuit's first en banc rehearing on a patent damages issue since 1995.
