Bob Van Nest Featured Among Daily Journal’s Top 100 Lawyers in California

The Daily Journal has once again included Bob Van Nest on its annual list of Top 100 Lawyers in California. Van Nest has a busy trial schedule this year, with two trials completed and two more on the way.

In January, he reached a settlement for Google over patents related to AI chips, just before closing arguments. The plaintiff, a Boston inventor, accepted a favorable offer. In March, Van Nest secured a victory for Dexcom in its patent dispute with Abbott over continuous glucose monitors. Abbott asserted 12 patents against Dexcom, but only four remained by trial. The jury found no infringement on two patents, hung on a third, and awarded no damages for the fourth.

Starting Sept. 9, Van Nest will defend a Sunnyvale cybersecurity company in a $250 million warranty claim trial. Then, on Oct. 8, he will tackle a copyright trial over programming language commands, arguing that common commands like “Set Clock” and “Analyze” shouldn’t receive copyright protection.

Van Nest and his team are also co-counsel for OpenAI and its ChatGPT artificial intelligence product, defending against lawsuits by authors and media outlets, including The New York Times, over the use of copyrighted material in AI training. Van Nest believes these cases are pivotal for the future of AI, as they address the fundamental training materials used by AI companies.
