Not Your Peers, But Your Judges: Jurors Tell All

ABA 2011 Fall National Legal Malpractice Conference
09/15/2011

The ABA Standing Committee on Lawyers’ Professional Liability presents the Fall 2011 National Legal Malpractice Conference, the nation’s preeminent forum on lawyers’ professional liability issues and developments.

Keker & Van Nest Partner Susan Harriman will speak on the panel:  "Not Your Peers, But Your Judges: Jurors Tell All." This panel will discuss how jurors assign blame when there is plenty to go around, and how can lawyers avoid or reduce it. Based on the conference hypothetical, attendees will learn tips from the expert panel and hear from live jurors about the cognitive processes they follow, as well as how to put clients on the right defensive path.

Since joining Keker & Van Nest in 1985 and becoming a partner in 1989, Ms. Harriman has handled a wide range of complex business litigation. She has tried state and federal cases involving legal malpractice defense, commercial disputes, real estate, and wrongful termination. She has also arbitrated cases before the American Arbitration Association and the National Association of Securities Dealers.

Additional sessions include:

  • An expert analysis of jury selection and composition, as well as insights from actual jurors.
  • The critical elements that must be pulled together in the last sixty days before trial to ensure a successful legal malpractice defense.
  • A thoughtful look at legal malpractice mediations and all of the stages in the mediation process, along with insights and tips from an expert panel.
  • An in-depth look at the emergence of cloud-based computing and its implications for professional liability claims.
